A dependent of an injured employee may not file a claim for compensation for an industrial injury pursuant to the provisions of chapters 616A to 616D, inclusive, of NRS if: 1. The time for filing the claim has expired pursuant to NRS 616C.020 and the failure to file the claim is not excused pursuant to NRS 616C.025; or 2. The injured employee or another dependent filed a claim for compensation for that industrial injury, the claim was denied and, upon final resolution of the claim, it was denied.
