Any physician, chiropractic physician, physician assistant or advanced practice registered nurse who attends an employee within the provisions of chapters 616A to 616D, inclusive, or chapter 617 of NRS in a professional capacity, may be required to testify before an appeals officer. A physician, chiropractic physician, physician assistant or advanced practice registered nurse who testifies is entitled to receive the same fees as witnesses in civil cases and, if the appeals officer so orders at his or her own discretion, a fee equal to that authorized for a consultation by the appropriate schedule of fees for physicians, chiropractic physicians, physician assistants or advanced practice registered nurses, if any. These fees must be paid by the insurer. 2. Information gained by the attending physician, chiropractic physician, physician assistant or advanced practice registered nurse while in attendance on the injured employee is not a privileged communication if: (a) Required by an appeals officer for a proper understanding of the case and a determination of the rights involved; or (b) The information is related to any fraud that has been or is alleged to have been committed in
