'Malpractice' means failure on the part of a behavior analyst, assistant behavior analyst or registered behavior technician to exercise the degree of care, diligence and skill ordinarily exercised by behavior analysts, assistant behavior analysts or registered behavior technicians, as applicable, in good standing in the community.
