1. The Board shall develop and implement a process by which a person who has been convicted of an excluded felony offense may submit to the Board a petition for an exemption from the provisions of: (a) Paragraph (b) of subsection 3 of NRS 678B.210. (b) Paragraph (b) of subsection 3 of NRS 678B.250. (c) Paragraph (a) of subsection 6 of NRS 678B.340. 2. The Board shall, in accordance with procedures established by the Board by regulation, review and evaluate each petition submitted pursuant to subsection 1 and grant or deny the exemption. The Board shall provide written notice to the petitioner of its decision to grant or deny the exemption. 3. The Board may grant an exemption pursuant to this section only if the Board determines that granting the exemption would not: (a) Pose a threat to the public health or safety; or (b) Negatively impact the cannabis industry in this State. 4. The Board may impose any conditions and limitations on the granting of an exemption pursuant to this section as the Board determines necessary to preserve the public health and safety or mitigate the impact of the granting of the exemption on the cannabis industry in this State.
