1. A public utility may enter into an agreement with a county to operate and maintain a facility acquired and constructed or to be acquired and constructed by a county pursuant to NRS 244.3661. The term of the agreement may be for more than 1 fiscal year. Any such agreement must be approved by the Commission before it becomes effective. 2. The Commission shall not approve an agreement executed pursuant to this section unless it determines that: (a) The payments to be made under the agreement to the utility for operation and maintenance of the facility are reasonable and just; and (b) The agreement is in the public interest.
