482:70 Appeal on Damages. – Any party aggrieved by an order of the department awarding damages may, within 60 days after entry of the order, file a petition in the superior court of the county in which the land is wholly or partially located to have the damages assessed by a jury, upon which petition notice shall be given, and the court shall assess such damages by jury. If the result of an appeal is to change the award of damages in favor of the appellant, he shall recover costs; otherwise, he shall pay costs. Source. 1989, 339:1. 1996, 228:106, eff. July 1, 1996.
