519:25 Lodging. – Jurors shall not be required to continue their deliberations without sleep and rest later than 12:00 in the evening. At that hour, or earlier, under such safeguards and conditions as the court may direct, they shall be afforded suitable opportunity for sleep and rest, at the expense of the state, for at least 8 hours before again taking up their deliberations. No separation for sleep or rest of men and women serving upon any jury shall work a mistrial in any civil or criminal case, if such jury is at all times in charge of a sheriff. Source. 1917, 11:2.
