554:30 Mortgage of Real Estate. – The judge, on application of the administrator or executor, with the assent of the heirs or devisees or, if minors or under disability, their guardians or conservators, may grant a license to mortgage the real estate of any person deceased, when the personal property shall be insufficient to pay the just demands by law chargeable to the estate, or to make necessary or desirable repairs to preserve such real estate, or where it is otherwise necessary to raise money to facilitate settlement of the estate.
