147:58 Civil Liability for Hazardous Waste Violations. – I. Any person who is convicted of violation of a permit, rule, standard, requirement, or order under RSA 147:55 and who is made a defendant in a civil action arising from that violation shall be liable to a successful plaintiff in an amount equal to 3 times any actual damages sustained by such plaintiff. II. The provisions of this section shall not relieve the plaintiff in any civil action from the burden of proving the defendant's liability. Source. 1981, 268:1, eff. Aug. 15, 1981.
