246:26 Appeal. – Any party aggrieved by the assessment of the department of transportation may, within 60 days after the report of the department of transportation thereon and not afterwards, appeal to the superior court in the county where such crossing may be situated, and the court shall assess the same by jury and award costs to the prevailing party.
