325-A:15 Acts Prohibited; Penalty. – I. Maintaining or operating a crematory in violation of this chapter or any rules of the board is a public nuisance and may be abated as a nuisance as provided by law. II. It shall be a felony to establish, operate, or maintain a crematory subject to this chapter without being licensed as a crematory authority under this chapter, to hold oneself out to the public as a crematory authority without being licensed, or to perform a cremation without a cremation authorization form signed by the authorizing agent and a completed permit for transit or cremation as provided by the board or a cremation permit. III. Signing a cremation authorization form with actual knowledge that the form contains false, incorrect, or misleading information is a felony. IV. A violation of any other provision of this chapter is a misdemeanor. Source. 2006, 288:2, eff. July 1, 2006.
