383:7-a Delegation of Duties and Responsibilities. – I. The commissioner may delegate to deputies, assistants, examiners, or employees of the department the exercise or discharge in the commissioner's name of any power, duty, or function, whether ministerial, discretionary or of whatever character, vested in or imposed upon the commissioner. However, the commissioner shall not delegate his or her rulemaking powers. II. The official act of the person acting in the commissioner's name and by his or her authority as provided in paragraph I shall be deemed an official act of the commissioner. III. The commissioner shall provide any board or commission written notice of his or her intent to delegate his or her duties and responsibilities to serve on such board or commission.
