13:1E-27. Solid waste facility deemed public utility 18. Any solid waste facility constructed, acquired or operated pursuant to the provisions of the 'Solid Wast Management Act,' P.L.1970, c.39 (C.13:1E-1 et seq.) shall be deemed a public utility and shall be subject to such rules and regulations as may be adopted by the Board of Public Utilities in accordance with the provisions of the 'Solid Waste Utility Control Act,' P.L.1970, c.40 (C.48:13A-1 et seq.) and P.L.1991, c.381 (C.48:13A-7.1 et al.).
