30:4D-17.5. Adjusted reimbursement rates The commissioner may establish adjusted reimbursement rates for skilled nursing and intermediate care facilities which experience financial hardship due to an average monthly Medicaid recipient census in excess of a percentage of licensed bed capacity as determined by the commissioner. The adjusted rates shall be adopted pursuant to the 'Administrative Procedure Act,' P.L. 1968, c. 410 (C. 52:14B-1 et seq.). L. 1985, c. 303, s. 8.
