A person who violates the provisions of Section 77-9-26 NMSA 1978 is guilty of a misdemeanor and upon conviction shall be sentenced in accordance with the provisions of Section 31-19-1 NMSA 1978 for each head in offense. ANNOTATIONSThe 1999 amendment, effective July 1, 1999, substituted 'sentenced in accordance with the provisions of Section 31-19-1 NMSA 1978 for each head in offense' for 'fined in a sum not less than twenty-five dollars ($25) and not more than five hundred dollars ($500) or by imprisonment not less than thirty days nor more than six months or by both such fine and imprisonment in the discretion of the court', and made a stylistic change at the beginning of the section. The 1993 amendment, effective June 18, 1993, added the current catchline; substituted 'Section 77-9-26 NMSA 1978 is' for 'the preceding Section shall be deemed'; and made minor stylistic changes.
