1. a. All penalties and fines accumulated prior to April first, nineteen hundred eighty-eight, pursuant to sections 71-2705, 71-2721 and 71-2723 of this title shall be paid over to the commissioner for deposit to the credit of the hazardous waste remedial fund established by section ninety-seven-b of the state finance law. b. All penalties and fines collected pursuant to sections 71-2705, 71-2721 and 71-2723 of this title shall be paid into the general fund to the credit of the state purposes account. 2. All moneys collected in any action brought on behalf of the state for damage resulting from improper or unlawful dissemination or disposal of hazardous wastes shall be paid over to the commissioner for deposit to the credit of the hazardous waste remedial fund established by section ninety-seven-b of the state finance law.
