No person, firm or corporation shall manufacture, distribute, import, or possess for the purpose of sale or resale, or sell or offer for sale in this state any toy, food, or other item which is fabricated, constructed or packaged to simulate hypodermic instruments. This article shall not apply to items contained in toy medical kits, any goods being transported through this state solely for the purpose of interstate commerce or to any goods used solely for: 1. lawful medical or educational purposes; or 2. use in a theatrical production, including a motion picture, television or stage production.
