A person who, after having been lawfully commanded to aid a police officer or peace officer in effectuating or securing an arrest or in preventing the commission by another of any offense, is killed or injured or his property or that of his employer is damaged and such death, injury or damage arises out of and in the course of aiding such officer, the person or employer so injured or whose property is so damaged or the personal representatives of the person so killed shall have a cause of action to recover the amount of such damage or injury against the municipal corporation by which such officer is employed at the time such command is obeyed. In the event of the death of the person so commanded to aid an officer, the action shall be governed by the provisions of part four of article five of the estates, powers and trusts law.
