The issuance and enforcement of a subpoena issued by the commissioner shall be governed by the civil practice law and rules, except that no employee of the office shall be entitled to special mileage or fees for the service of such subpoena. The commissioner shall not be required to issue a subpoena if such subpoena may be issued by counsel for the party requesting such subpoena.
