fare law, chapter six hundred seventy-eight of the laws of nineteen hundred twenty-eight constituting the grade crossing elimination act, as amended, or chapter eight hundred sixty-two of the laws of nineteen hundred thirty-six, as amended, the amount, if any, of such judgment, inclusive of interest thereon as allowed by law, which exceeds the amount of moneys otherwise appropriated and available for the payment thereof shall be paid out of the state treasury from moneys appropriated to the court of claims for general state charges.
