§ 58-51-16

\n(a) Except for the payment of benefits for the necessary care and treatment of chemical dependency as provided by law, an accident and health insurer shall not be liable for any loss sustained or contracted in consequence of the insured's being intoxicated or under the influence of any narcotic unless administered on the advice of a physician.\n(b) The provision in subsection (a) of this section may not be used with respect to a medical expense policy.\n(c) For purposes of this section, 'medical expense policy' means an accident and health insurance policy that provides hospital, medical, and surgical expense coverage.
