Effective: October 3, 2023 Latest Legislation: House Bill 33 - 135th General Assembly (A) When establishing the number of cultivator licenses that will be permitted at any one time, the division of marijuana control shall consider both of the following: (1) The population of this state; (2) The number of patients seeking to use medical marijuana. (B) When establishing the number of retail dispensary licenses that will be permitted at any one time, the division shall consider all of the following: (1) The population of this state; (2) The number of patients seeking to use medical marijuana; (3) The geographic distribution of dispensary sites in an effort to ensure patient access to medical marijuana. (C) When establishing standards and procedures for the testing of medical marijuana, the division shall do all of the following: (1) Specify when testing must be conducted; (2) Determine the minimum amount of medical marijuana that must be tested; (3) Specify the manner in which testing is to be conducted in an effort to ensure uniformity of medical marijuana products processed for and dispensed to patients; (4) Specify the manner in which test results are provided.
