Effective: December 31, 2017 Latest Legislation: House Bill 49 - 132nd General Assembly Any application for public assistance gives a right of subrogation to the department of job and family services for any workers' compensation benefits payable to a person who is subject to a support order, as defined in section 3119.01 of the Revised Code, on behalf of the applicant, to the extent of any public assistance payments made on the applicant's behalf. If the director of job and family services, in consultation with a child support enforcement agency and the administrator of the bureau of workers' compensation, determines that a person responsible for support payments to a recipient of public assistance is receiving workers' compensation, the director shall notify the administrator of the amount of the benefit to be paid to the department of job and family services.For purposes of this section, 'public assistance' means Ohio works first provided under Chapter 5107. of the Revised Code or prevention, retention, and contingency benefits and services provided under Chapter 5108. of the Revised Code.
