Effective: January 1, 1966 Latest Legislation: Senate Bill 94 - 106th General Assembly When the officers having control or management of a public cemetery deem it necessary to appropriate property for a new and better approach to the cemetery, and have passed a resolution declaring the necessity thereof and their intention to make such appropriation, they shall make application to the court of common pleas or to a judge thereof in vacation, or to the probate court of the county in which the property or a part thereof is located, in the manner prescribed in section 163.05 of the Revised Code, and the proceedings therefor shall be conducted as prescribed by sections 163.01 to 163.22, inclusive, of the Revised Code.
