Effective: September 12, 2008 Latest Legislation: Senate Bill 175 - 127th General Assembly (A) As used in this section and section 759.491 of the Revised Code, 'fetal death' has the same meaning as in section 3705.01 of the Revised Code. (B) The legislative authority of a municipal corporation owning a public burial ground or cemetery, whether within or without the municipal corporation, may pass and provide for the enforcement of ordinances for the burial, re-interment, or disinterment of the product of a fetal death in that public burial ground or cemetery.(C) With regard to the product of a fetal death, on the request of the mother and in compliance with the public burial ground or cemetery's ordinances, a public burial ground or cemetery shall inter the product of the fetal death in accordance with one of the following:(1) In a single grave within the public burial ground or cemetery that contains, or will contain, the remains of a parent, sibling, or grandparent;(2) In another location of the public burial ground or cemetery, including a separate burial ground for infants, on a temporary or permanent basis.
