A. A gestational carrier may receive reimbursement for expenses and economic losses resulting from participation in the gestational carrier arrangement contemplated by a gestational agreement. B. A gestational carrier may be paid a reasonable compensation for carrying a child pursuant to a gestational agreement. The compensation, if any, paid to a gestational carrier must be negotiated in good faith between the parties; the amount of such compensation must be set forth in the gestational agreement; and the compensation may in no manner be conditioned upon the purported quality or any genome-related traits of the sperm, eggs, gametes, embryos or resulting child; provided, that nothing in this section prohibits compensation that is conditioned on the number of embryos implanted, the number of assisted reproduction procedures undertaken for the gestational carrier to become pregnant, the number of children with which the gestational carrier becomes pregnant or the duration of the pregnancy.Added by Laws 2019, c. 433, § 18, emerg. eff.
