(1) In any appeal or petition for review subject to a fee under ORS 21.010, a $53 fee must be paid by the party filing one of the following motions and by the party responding to the motion:\n(a) A motion to dismiss filed by a respondent.\n(b) A motion to determine jurisdiction.\n(c) A motion for continuance.\n(d) A motion for an extension of time for the filing of a brief or other document in the proceeding.\n(2) The fees provided for in this section may not be collected from the state, a county, a city or a school district.
