As used in ORS 30.490 to 30.497:\n(1) 'Discharge' means any leakage, seepage or any other release of hazardous material.\n(2) 'Hazardous material' means:\n(a) Hazardous waste as defined in ORS 466.005;\n(b) Hazardous substances as defined in ORS 453.005;\n(c) Radioactive waste as defined in ORS 469.300;\n(d) Uranium mine overburden or uranium mill tailings, mill wastes or mill by-product materials;\n(e) Radioactive substance as defined in ORS 453.005;\n(f) Any substance designated by the United States Department of Transportation as hazardous pursuant to the Hazardous Materials Transportation Act, 49 U.S.C. 5101 et seq., P.L. 93-633, as amended; and\n(g) Any substance that the Environmental Protection Agency designates as hazardous pursuant to:\n(A) The federal Toxic Substances Control Act, 15 U.S.C. 2601 to 2671; or\n(B) The federal Resource Conservation and Recovery Act, 42 U.S.C. 6901 to 6992, P.L. 94-580, as amended.\n(3) 'Person' means an individual, corporation, association, firm, partnership, joint stock company or state or local government agency.
