The immunity provided in ORS 30.492 shall not apply to any person:\n(1) Whose act or omission caused in whole or in part the actual or threatened discharge and who would otherwise be liable for the damages; or\n(2) Who receives compensation other than reimbursement for expenses for the person’s service in rendering such assistance or advice.
