(1) A contracting agency may award a public contract for goods or services that does not exceed a contract price of $25,000 in any manner the contracting agency deems practical or convenient, including by direct selection or award. A contract awarded under this section may be amended to exceed $25,000 only in accordance with rules adopted under ORS 279A.065.\n(2) A state contracting agency that awards a public contract with a contract price of $10,000 or more using a method permitted under this section shall document in the state contracting agency’s procurement file the actions the state contracting agency takes to:\n(a) Comply with ORS 200.035; and\n(b) Consider for the procurement businesses or enterprises that the Certification Office for Business Inclusion and Diversity certifies under ORS 200.055.\n(3) A contracting agency may not artificially divide or fragment a procurement so as to constitute a small procurement under this section.
