(1) As used in ORS 279C.345 and 279C.350, 'findings' means the justification for a contracting agency conclusion that includes, but is not limited to, information regarding:\n(a) Operational, budget and financial data;\n(b) Public benefits;\n(c) Value engineering;\n(d) Specialized expertise required;\n(e) Public safety;\n(f) Market conditions;\n(g) Technical complexity; and\n(h) Funding sources.\n(2) As used in ORS 279C.335, 'findings' means the justification for a conclusion that a contracting agency or state agency, in seeking an exemption from the competitive bidding requirement of ORS 279C.335 (1), reaches based on the considerations set forth in ORS 279C.335 (2).
