For the purpose of requesting a state or nationwide criminal records check under ORS 181A.195, the Oregon Military Department may require the fingerprints of:\n(1) A person who is applying for or is employed in a position in a job category for which a state or nationwide criminal records check is a job qualifier and in which personnel:\n(a) Are assigned to the at-risk youth alternative education program;\n(b) Are issued firearms and munitions;\n(c) Have fiscal and purchasing responsibilities as their primary responsibilities; or\n(d) Have regular access to restricted areas within a military installation.\n(2) A person who is applying to join the organized militia of this state, as described in ORS 396.105, or is a member of the organized militia of this state.
