Covered drugs must be disposed of:\n(1) At a hazardous waste disposal facility that meets the requirements of 40 C.F.R. parts 264 and 265, as in effect on September 29, 2019;\n(2) At a municipal solid waste incinerator that is permitted to accept pharmaceutical waste; or\n(3) At a hospital, medical and infectious waste incinerator:\n(a) That is subject to and meets the requirements of:\n(A) 40 C.F.R. part 62, subpart HHH, as in effect on May 16, 2023; or\n(B) 40 C.F.R. part 60, subpart Ec, as in effect on May 16, 2023; or\n(b) That is covered by a state or tribal plan for existing hospital, medical and infectious waste incinerators approved by the federal Environmental Protection Agency.
