(1) An eligible business or third-party delivery facilitator may employ or contract with a delivery person to deliver alcoholic beverages to the physical possession of a final consumer at a delivery address only if the individual:\n(a) Is at least 18 years of age; and\n(b) Has a valid driver license or other state-issued identification.\n(2) Prior to making any deliveries of alcoholic beverages, a delivery person shall first complete the training program and be issued a certificate of completion, as described in ORS 471.527.\n(3) A delivery person may also be a third-party delivery facilitator that holds a permit issued under ORS 471.534.\n(4) A delivery person may charge an eligible business a fee for delivering alcoholic beverages on behalf of the eligible business.\n(5) A violation of subsection (1) of this section:\n(a) Upon a first conviction, is a Class A violation.\n(b) Upon a second or subsequent conviction, is a Class A misdemeanor.
