(1) As used in this section:\n(a) 'Consumer' means a person who purchases, acquires, owns, holds or uses marijuana items other than for the purpose of resale.\n(b) 'Marijuana item' includes an industrial hemp commodity or product that exceeds:\n(A) The concentration of adult use cannabinoids established by the Oregon Liquor and Cannabis Commission, in consultation with the Oregon Health Authority and the State Department of Agriculture, by rule; or\n(B) The greater of:\n(i) A concentration of 0.3 percent total delta-9-tetrahydrocannabinol; or\n(ii) The concentration of total delta-9-tetrahydrocannabinol allowed under federal law.\n(2) A person other than a marijuana retailer that holds a license issued under ORS 475C.097 may not sell marijuana items to a consumer.
