(1) Upon the request of the holder and the approval of the Water Resources Department, a hydroelectric water right or claim may be amended.\n(2) The Water Resources Department shall develop rules governing the process by which a hydroelectric water right or claim may be amended. Any amendments under subsection (1) of this section shall:\n(a) Be consistent with the final unified state position for the project;\n(b) Be consistent with the requirements of ORS chapter 543A;\n(c) Cause no injury to other water rights; and\n(d) Allow for public participation in the amendment process.\n(3) The Water Resources Director may unilaterally amend a power claim or uncertificated claim in order to assess project specific fees under ORS 543.080.
