(1) A dealer injured by a warrantor’s violation of ORS 650.390, 650.400, 650.410 or 650.460 may bring a civil action against the warrantor to recover the dealer’s actual damages.\n(2) A warrantor injured by a dealer’s violation of ORS 650.410 or 650.460 may bring a civil action against the dealer to recover the warrantor’s actual damages.\n(3) The court shall award reasonable attorney fees to the prevailing party in an action under this section.
