§ 127a09

If deemed practicable by the department, the department may salvage and sell at private or public sale any material derived from an abatement of a public nuisance. Pursuant to ordinance, all of the following shall apply to the proceeds obtained from the sale of any material salvaged as a result of an abatement: (1) The proceeds shall be deposited as directed by ordinance. (2) The proceeds may be applied against the amount of the costs, fees and penalties relating to the abatement. (3) If the amount of the proceeds exceeds the amount of the costs, fees and penalties, any excess shall be paid to the owner.
