Within 30 days after receipt of the notice of assessment, an owner of property shall have the right to appeal the assessment to the court of common pleas in the county in which the assessed property is located. On appeal, unless the court finds fraud, mistake or illegality, the court shall be restricted to determining the following questions: (1) Whether the property assessed received any special benefits from the improvement. (2) Whether the assessment made exceeds the special benefits received.
