Section 6346 - Costs from nonaffiliated entity

A closed-end credit agreement and an open-end credit agreement may provide for the reimbursement from a buyer of costs for a service provided by an entity that is not otherwise affiliated with the seller or holder if all the following conditions exist: (1) The buyer requests that the seller or holder provide the service. (2) The service is for the convenience of the buyer. (3) The seller or holder contracts with the entity to provide the service to the buyer or other buyers. (4) The seller or holder actually incurs the costs of the service provided by the entity. (5) The costs incurred for the service are reasonable and necessary. (6) The reimbursement costs received from the buyer do not exceed the costs incurred by the seller or holder. Cross References. Section 6346 is referred to in section 6302 of this title.
