Section 16119 - Compliance with workers' compensation law

(a) General rule.--Each contract executed by the county commissioners, which involves the construction or doing of any work involving the employment of labor, shall contain a provision that the contractor shall accept, in so far as the work covered by a contract is concerned, the provisions of the act of June 2, 1915 (P.L.736, No.338), known as the Workers' Compensation Act, and that the contractor will insure contractor's liability under the act or file with the county commissioners a certificate of exemption from insurance from the Department of Labor and Industry. (b) Proof of compliance.--The county commissioners, before signing on behalf of the county a contract requiring in its performance the employment of labor, shall require proof that the contractor with whom the contract is made shall have accepted the Workers' Compensation Act and any reenactments, supplements or amendments to the act, and proof that the contractor has complied with subsection (a). (c) Violation.--A contract executed in violation of the provisions of this section shall be null and void.
