Section 17342 - Sovereign immunity

The following apply: (1) An authority created under this subchapter, and the authority's officers, officials and employees, shall have sovereign and official immunity, as provided under 1 Pa.C.S. § 2310 (relating to sovereign immunity reaffirmed; specific waiver). (2) An authority created under this subchapter, and the authority's officers, officials and employees, shall remain immune from suit, except as provided by and subject to 42 Pa.C.S. §§ 8501 (relating to definitions), 8502 (relating to enforcement proceedings), 8521 (relating to sovereign immunity generally), 8522 (relating to exceptions to sovereign immunity), 8523 (relating to venue and process), 8524 (relating to defenses), 8525 (relating to legal assistance), 8526 (relating to counterclaim by the Commonwealth), 8527 (relating to indemnity relating to inmate health care) and 8528 (relating to limitations on damages). (3) Notwithstanding 42 Pa.C.S. § 8525, the authority, through the authority's counsel, shall defend actions brought against the authority and the authority's officers and employees when acting within the scope of the officers and employees' official duties.
