\nThe following words and phrases when used in this chapter shall have the meanings given to them in this section unless the context clearly indicates otherwise:\n'Active ingredient.'\nA soil-amending or plant-amending ingredient that is not a plant nutrient.\n'Brand.'\nThe term, designation, trademark, product name or other specific designation under which individual soil amendments or plant amendments are offered for sale.\n'Consumer.'\nA person who purchases a soil amendment or plant amendment for the end use of the product.\n'Department.'\nThe Department of Agriculture of the Commonwealth.\n'Distribute.'\nTo import, consign, offer for sale, sell, barter or otherwise supply soil amendments and plant amendments in this Commonwealth.\n'Facility.'\nEach separate mill or plant manufacturing a soil amendment or plant amendment.\n'Guarantor.'\nThe person whose name and address appears on the label of a soil amendment or plant amendment.\n'Label.'\nThe display of all written, printed or graphic matter upon the immediate container or statement accompanying a soil amendment or plant amendment.\n'Labeling.'\nAll written, printed or graphic matter upon or accompanying

ritten, printed or graphic matter upon the immediate container or statement accompanying a soil amendment or plant amendment.\n'Labeling.'\nAll written, printed or graphic matter upon or accompanying any soil amendment or plant amendment or advertisements, brochures, posters or electronic media used in promoting the distribution of such soil amendment or plant amendment.\n'Manufacture.'\nTo produce, mix, blend, repackage or further process a soil amendment, plant amendment, soil-amending ingredient or plant-amending ingredient for distribution.\n'Minimum percentage.'\nThat percent of soil-amending ingredient or plant-amending ingredient that must be present in a product before the product will be accepted for registration.\n'Official sample.'\nA sample of soil amendment or plant amendment taken by the department or its agent to effect the provisions of this chapter and designated as official.\n'Other ingredients.'\nNon-soil-amending or non-plant-amending inert ingredients present in soil amendments or plant amendments.\n'Person.'\nAn individual, partnership, association, firm, corporation or any other legal entity.\n'Plant amendment.'\nAny substance applied to plants or seeds

in soil amendments or plant amendments.\n'Person.'\nAn individual, partnership, association, firm, corporation or any other legal entity.\n'Plant amendment.'\nAny substance applied to plants or seeds which is intended to improve germination, growth, yield, product quality, reproduction, flavor or other desirable characteristics of plants, except fertilizers, soil amendments, agricultural liming materials, unmanipulated animal and vegetable manures, pesticides and other materials which may be exempted by regulation.\n'Plant-amending ingredient.'\nA substance that will improve germination, growth, yield, product quality, reproduction, flavor or other desirable characteristics of plant.\n'Secretary.'\nThe Secretary of Agriculture of the Commonwealth or the secretary's designee.\n'Soil amendment.'\nAny substance which is intended to change the chemical or physical characteristics of soil. The term does not include fertilizers, agriculture liming materials, unmanipulated animal and vegetable manures, pesticides and other materials exempted by regulation.\n'Soil-amending ingredient.'\nA substance which changes the chemical or physical characteristics of soil.\n'Tolerance.'\nA permitted
