No person, entity, association, corporation, or the Commonwealth Government or any municipality or other political subdivision, or any department, division, board, agency or instrumentality thereof, shall establish, operate or maintain an establishment for the care of the elderly unless, before commencing operations, it requests and is granted the license required by § 354 of this title. Those persons who take care of one (1) or two (2) elderly persons, or any person who takes care of aged persons to whom he is related by consanguinity or affinity shall be exempted from complying with this provision.
