If after considering the evidence introduced during the hearing on its merits, which shall take place within fifteen (15) days following the decision, the corresponding part of the Court of First Instance of Puerto Rico finds that the circumstances which caused the removal and emergency custody still exist, or that other conditions that require said action exist, said court shall award temporary custody to the Department and schedule a follow-up hearing.
