Any natural or juridical person, importer or owner of any animal suffering from or a carrier of any infectious, contagious, or transmissible disease that refuses to destroy and bury or incinerate the same after being so requested by the employees of the Department of Agriculture, shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than thirty dollars ($30) nor more than two hundred dollars ($200), or by imprisonment in jail for a term of not less than thirty (30) days nor longer than two (2) months, or by both penalties, in the discretion of the court; it being understood that in case of a second offense, such natural or [juridical] person shall be punished by a fine of not less than two hundred dollars ($200) nor more than two thousand dollars ($2,000), or by imprisonment in jail for a term of not less than two (2) months nor longer than one year, or by both penalties, in the discretion of the court.
