If the owner of the cattle subject to the provisions of §§ 757—764 of this title has them on leased lands, he shall have the right to construct on such lands the tank or tanks which he is obliged to so construct in proportion to the number of head of cattle owned by him, and the construction of said tank shall be at the expense of the owner of the cattle pursuant to the provisions of §§ 757—764 of this title.
