Any pedestrian bridge that is built over a public thoroughfare and whose design stage begins as of June 1, 2012, shall include in its structure a safety fence that shall cover it. In all existing overpasses for both pedestrian and vehicular traffic whose structural conditions allow for said fence to be included in the design, and for which a certification issued by a structural engineer duly licensed by the College of Engineers and Land Surveyors of Puerto Rico, one safety fence that complies with the height established through regulations adopted by the Highways and Transportation Authority (HTA) for such purpose shall be placed.The existing pedestrian bridges or overpasses for both pedestrian and vehicular traffic that, on the date of approval of this act, lack a safety fence shall be renovated commencing on June 1, 2012.
