It shall be illegal for any person to move or alter any easement landmark of a highway or move any existing fence for the purposes of altering the boundaries of the property with the highway. In the event that it so happens, the person responsible shall proceed immediately to perform the works necessary to restore said landmarks or fences to their original place. Any person who intentionally violates the provisions of this section shall be guilty of a misdemeanor and upon conviction punished, for the first violation, by a fine of not less than fifty [dollars] ($50) nor more than three hundred dollars ($300). In cases of recidivism or of subsequent violations, there shall be imposed a fine of not less than three hundred [dollars] ($300) nor more than five hundred dollars ($500) or imprisonment in jail for a term of not more than thirty (30) days, or both penalties, in the discretion of the court.\nHistory —May 30, 1973, No. 54, p. 135, § 4-07, eff. 30 days after May 30, 1973.
