Any person wishing to construct an access on any highway other than an express highway or a highway of limited or controlled accesses shall justify the need therefor, and shall obtain the corresponding permit from the Secretary. The access shall conform with the standards and conditions established by the Department, taking into consideration the safety of traffic and the best maintenance of the highway. Any person who constructs accesses without the due permit or in violation of the conditions established therein shall be punished as provided by § 2504 of this title and the access so constructed shall be eliminated and the fence replaced at the easement points. Any person who destroys the fence or railing so built for the purpose of entering or leaving the property shall be guilty of a misdemeanor and upon conviction punished by a fine of not less than one hundred dollars ($100) or imprisonment in jail for a term of not less than thirty (30) days, or both penalties, in the discretion of the court.\nHistory —May 30, 1973, No. 54, p. 135, § 5-05, eff. 30 days after May 30, 1973.
